These Terms of Use ("Terms") are an agreement between you and Zhorobekov Ermek ("we", "us") and govern your use of the Birdio app and related services ("the Service"). By using Birdio you agree to these Terms. If you do not agree, do not use the Service.

In short (this summary is for convenience; the full sections below govern):

• Bird identifications are AI estimates and can be wrong. Never rely on them for decisions about safety, eating, or the law (Sections 4-5).
• Subscriptions renew automatically until cancelled in your Apple ID settings; deleting the app does not cancel a subscription (Section 6).
• Your photos and recordings stay yours, and we never use them to train models (Section 9).
• Be kind to birds: don't use the app to disturb wildlife or reveal where rare birds nest (Section 5).

1. App Store

Birdio is distributed through the Apple App Store. Your license to the app copy is governed by Apple's Licensed Application End User License Agreement (Standard EULA) and Apple's Media Services Terms. These Terms apply in addition to the Standard EULA; if they conflict regarding the app license or purchases, the Standard EULA and Apple's terms prevail. Apple is not a party to these Terms and is not responsible for the Service or its content.

2. Eligibility

You must be old enough to form a binding agreement in your country. If you are a minor, you may use Birdio only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

3. The Service

Birdio identifies bird species from sounds and photos using machine-learning models, and provides species information, a personal collection (life list), and quizzes. Sound identification runs on your device and works offline. Photo identification runs either on your device (an offline model, part of Birdio Pro, that is downloaded on demand and needs an internet connection and free storage to install) or via a cloud AI service, with your consent. Species reference content (photos, descriptions, maps, sounds) is loaded from third-party open-data sources and requires an internet connection. You are responsible for any network or data charges from your carrier (including roaming) incurred by using online features.

4. AI results disclaimer

Identifications are produced by probabilistic machine-learning algorithms. They are estimates, not facts: they can be wrong, incomplete, or misleading, especially for rare species, poor recordings, or unusual photos. All results, confidence scores, and species information are provided for informational and educational purposes only and do not constitute professional, scientific, veterinary, medical, or legal advice. You are responsible for evaluating and bearing all risks associated with relying on any result.

5. Wildlife and nature safety

• Never rely on the app to decide whether any animal, plant, fungus, or other organism is safe to touch, approach, handle, feed, or eat. Birdio is not a tool for assessing edibility, toxicity, disease risk, or safety of any kind.
• Do not use identifications to make decisions with legal consequences (e.g. hunting, capture, trade, or possession of a species). Verify the legal status of any species with the competent authorities.
• Respect wildlife and the law: keep distance from nests and breeding sites, do not disturb protected species, and avoid playing bird calls near sensitive species or in protected areas where playback is restricted.
• Do not publicly share precise locations of nests, roosts, or rare and sensitive species. Such information can expose birds to disturbance, capture, or persecution.
